Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and RX Fitness Lab, based in Morocco ("RX Fitness Lab", "we", "us"). They govern your use of the RX Fitness Lab mobile application (the "App"), the website rxfitnesslab.com (the "Website") and all related features, content and subscriptions (together, the "Services").

By creating an account, signing in (including with Apple or Google), starting a free trial, purchasing a subscription or otherwise using the Services, you confirm that you have read and accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.

The Services provide general fitness and nutrition information, including training programs, exercise demonstrations, calorie and macronutrient targets and meal analysis. They are not medical advice, are not a medical device and do not diagnose, treat, cure or prevent any disease or condition. Nothing in the Services replaces advice from a doctor, dietitian or other qualified health professional.

Consult a doctor before starting any exercise or nutrition program, and in particular if you:

• —are pregnant, breastfeeding or recently gave birth;
• —have, or have had, a heart, lung, joint, bone, metabolic or other medical condition, or take prescription medication;
• —have, or have had, an eating disorder or a difficult relationship with food or body weight;
• —are recovering from an injury or surgery, or are under 18.

Exercise carries an inherent risk of injury. Stop immediately and seek medical help if you feel pain, dizziness, shortness of breath, chest discomfort or any other unusual symptom. You are responsible for choosing weights, intensity and exercises appropriate to your abilities, for using equipment safely and for training in a safe environment.

Calorie, macronutrient, weight-change and goal-date figures are estimates based on standard formulas and the information you provide. Individual results vary and are not guaranteed. We set minimum calorie intakes for safety, but you remain responsible for your own health decisions. Never follow a target that feels unsafe for you.

To the fullest extent permitted by law, you participate in any physical activity suggested by the Services voluntarily and at your own risk.

Some features use artificial intelligence, including program generation, exercise swaps and photo-based meal analysis. AI output is produced automatically, may be inaccurate, incomplete or unsuitable for you, and is not reviewed by a professional before it is shown to you. For example, a meal photo may be misidentified or its nutritional values mis-estimated.

Use your own judgement and check important information. Do not rely on AI output for medical, allergy or other safety-critical decisions.

You must be at least 14 years old to use the Services. If you are under 18, or under the age at which you can consent to the processing of your personal data in your country, you may use the Services only with the permission of a parent or legal guardian who has read and agrees to these Terms on your behalf and who is responsible for your use of the Services.

You must be legally able to enter into this agreement and must not be barred from using the Services under any applicable law.

You may need an account to use the Services. You agree to provide accurate information, including the personal and health details you enter during onboarding, and to keep it up to date. The quality of your program and targets depends on it.

You are responsible for keeping your login credentials secure and for all activity under your account. Tell us immediately at support@rxfitnesslab.com if you suspect unauthorised use. Accounts are personal and may not be shared, sold or transferred.

Some features require a paid subscription ("Premium"). Prices, billing periods and included features are shown before you buy. Prices include any taxes required by law unless stated otherwise.

Subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel at least 24 hours before the renewal date. Where we offer a free trial, you will be charged when the trial ends unless you cancel before then. We will tell you before any price change takes effect, and you can cancel before it applies.

If you subscribe through the Apple App Store or Google Play, your purchase is processed and billed by Apple or Google under their terms. You manage or cancel the subscription in your App Store or Google Play account settings; deleting the App does not cancel it. Refund requests for these purchases are handled by Apple or Google under their refund policies.

If you subscribe on the Website, payment is processed by our payment provider (Stripe). You can cancel at any time from your account or by contacting us; cancellation takes effect at the end of the current billing period and you keep access until then. Except where required by law, payments are non-refundable and we do not refund partial billing periods.

Right of withdrawal (EU, UK and similar consumers): if you are a consumer with a legal right to withdraw from distance contracts, you normally have 14 days to withdraw from a subscription bought on the Website. By starting to use Premium during that period, you expressly request that the service begins immediately and acknowledge that, if you withdraw, we may deduct an amount proportionate to the service already provided, and that for digital content supplied in full you lose your right of withdrawal. To withdraw, email support@rxfitnesslab.com within the withdrawal period.

If your account is managed by a coach or your access is suspended, Premium features may be unavailable until access is restored.

You agree not to:

• —use the Services for any unlawful, harmful or fraudulent purpose;
• —upload content that is illegal, infringing, offensive, or that contains other people's personal data or images without their consent;
• —copy, resell, sublicense or commercially exploit the Services or their content, including programs and exercise videos;
• —reverse engineer, decompile, scrape, or attempt to access our systems, source code or other users' data, except where the law expressly allows it;
• —interfere with, overload or disrupt the Services, or bypass any security, payment or access restriction;
• —use automated means, bots or AI tools to access or extract data from the Services.

You keep ownership of the content you submit, such as meal photos, workout logs, body measurements, progress photos and notes ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, analyse and display Your Content only as needed to operate, provide and improve the Services for you, including sending it to our service providers such as AI providers for analysis. This licence ends when Your Content is deleted from our systems, except where retention is required by law or described in our Privacy Policy.

You confirm that you have the rights needed to submit Your Content and that it does not infringe anyone's rights. How we handle personal data, including health data, is described in our Privacy Policy.

The Services, including the App, Website, software, programs, exercise videos, text, graphics, logos and the "RX Fitness Lab" name, are owned by RX Fitness Lab or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Services for your own non-commercial purposes. All rights not expressly granted are reserved.

If you send us feedback or suggestions, we may use them without any obligation to you.

The Services work with third-party services, including Apple (Sign in with Apple, Apple Health, the App Store), Google (Google Sign-In, Health Connect, Google Play), payment providers and AI providers. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. Connecting Apple Health or Health Connect is optional and you can revoke access at any time in your device settings.

If you downloaded the App from the Apple App Store, the following also applies:

• —These Terms are between you and RX Fitness Lab only, not Apple. RX Fitness Lab, not Apple, is solely responsible for the App and its content.
• —Your licence to use the App is limited to Apple-branded devices you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
• —Apple has no obligation to provide maintenance or support services for the App.
• —If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
• —RX Fitness Lab, not Apple, is responsible for addressing any claims relating to the App or your use of it, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• —If a third party claims that the App or your use of it infringes their intellectual property rights, RX Fitness Lab, not Apple, is responsible for investigating, defending, settling and discharging that claim.
• —You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• —You must comply with applicable third-party terms when using the App.
• —Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple may enforce them against you.

If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service. Where these Terms conflict with the applicable store's mandatory terms, the store's terms apply to that extent.

We work to keep the Services available and accurate, but we do not guarantee that they will be uninterrupted, error-free or available on every device. We may change, add or remove features, content or programs, and may suspend the Services for maintenance, security or legal reasons. If we permanently remove a material Premium feature you have paid for, you may cancel and, where required by law, receive a proportionate refund for the unused period.

You can stop using the Services at any time and delete your account in the App (Profile → Settings). Deleting your account deactivates it and ends your access; some data may be kept as described in our Privacy Policy, for example where required by law. Deleting your account does not cancel an App Store or Google Play subscription — cancel it in your store settings.

We may suspend or terminate your access, with notice where reasonably possible, if you seriously or repeatedly breach these Terms, if required by law, or to protect the Services, other users or third parties. Sections that by their nature should survive termination (including sections 2, 3, 8, 9, 14, 15, 16 and 17) continue to apply.

To the fullest extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise any particular fitness, health, weight or body-composition result.

Nothing in these Terms limits any rights you have as a consumer that cannot be excluded or limited under the law of your country.

To the fullest extent permitted by law, RX Fitness Lab will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or opportunity, arising out of or related to the Services or these Terms.

To the fullest extent permitted by law, our total liability for all claims relating to the Services or these Terms is limited to the greater of (a) the amount you paid us for the Services in the 12 months before the event giving rise to the claim, and (b) 100 euros (or the equivalent in your currency).

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot be excluded or limited by law.

To the extent permitted by law, you agree to compensate RX Fitness Lab for reasonable losses and costs arising from claims by third parties caused by your breach of these Terms, your misuse of the Services or Your Content. This does not apply to the extent the loss was caused by us, and does not limit your mandatory rights as a consumer.

These Terms are governed by the laws of the Kingdom of Morocco. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in the courts of that country.

Before starting any formal proceedings, please contact us at support@rxfitnesslab.com so we can try to resolve the issue informally. Subject to your mandatory consumer rights, the courts of Morocco have jurisdiction over any dispute.

We may update these Terms to reflect changes to the Services, the law or our business. We will update the "Last updated" date and, for material changes, notify you in the App, by email or on the Website before the changes take effect. If you keep using the Services after the changes take effect, you accept the updated Terms; if you do not agree, you must stop using the Services and cancel any subscription.

These Terms, together with our Privacy Policy and any terms shown at the point of purchase, are the entire agreement between you and us about the Services. If any provision is found invalid or unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours to a successor business, provided your rights are not reduced. We are not liable for delays or failures caused by events beyond our reasonable control.

These Terms may be provided in several languages. If there is any conflict between versions, the English version prevails, except where the law of your country requires otherwise.
